Commercial and Construction Law

Blankenship & Blankenship has substantial experience assisting clients in many different forms of  commercial legal matters and disputes.  Specifically, the firm has years of experience representing members of the construction industry from the initial contract negotiation and review stage through the resolution of disputes that may arise over the course of a construction project. John Blankenship for many years represented general contractors, subcontractors, design professionals  and owners in matters unique to the construction industry. His practice focused on commercial construction and residential construction matters. His  philosophy of efficient resolution of disputes was always designed  to serve his clients’  best interests.  Today, he serve as in house counsel for Construction Enterprises, Inc., a commercial general contractor with a national presence, and brings all his experiences as an attorney to his arbitration and mediation practice.  He is well versed on every aspect of the construction process, from contract negotiation to completion, including the navigation of payment disputes, construction/design defect claims, delay and inefficiency claims, perfection of mechanics’ and materialman’s liens, and resolution of breach of contract claims.

Real Estate Law

In addition to assisting its construction  clients with the preparation of deeds and related documents, Blankenship & Blankenship has significant experience closing large commercial loans, particularly HUD endorsed loans.    John Blankenship has also represented clients in various real estate disputes for over 30 years; specifically, the mediation, arbitration and litigation of real estate related matters.


John Blankenship has been a commercial arbitrator for almost three decades.   He was appointed to the American Arbitration Association panel of arbitrators 1987.  A large part of his ADR practice is devoted to serving as an arbitrator of commercial, real estate and construction disputes.  He has served as either a sole arbitrator or as a member on three-arbitrator panels in hundreds of cases.   His experience includes both domestic and international cases and involves administered and non-administered cases.  John is the only Tennessee arbitrator to be elected as a Fellow in the College of Commercial Arbitrators in which he is a member of the Board of Directors.   He is a published author and frequent lecturer and trainer in arbitration matters and he often serves as a consultant to businesses and law firms in arbitration matters.  He has been recognized by Best Lawyers® in the field of ADR again for the year 2012.

John Blankenship has served as a mediator in hundreds of commercial disputes.  He is often sought after to mediate complex and multi-party disputes in not only Tennessee, but throughout the southeast.  John is a frequent lecturer and writer in the field of mediation.    He has been recognized by Best Lawyers® in the field of ADR again for the year 2012.

John Blankenship has structured many hybrid dispute resolution procedures and has served as Neutral in several cases in which Med-Arb has been employed.
